Terms of Use for VITyarthi - E-learning Website and App

1. Introduction

This agreement ("Agreement") governs your use of the software, mobile applications, services, and other offerings provided by Kalvi Educational Technologies LLP, operating under the brand "VITyarthi" ("we," "us," or "our"). By using any of our products or clicking the "signup" button, you agree to be bound by the terms and conditions outlined in this Agreement. If you do not agree to these terms, click on the "cancel" button and refrain from using our products.

2. Additional Terms

a. Privacy Policy:

• Any personal information submitted is subject to our Privacy Policy, which is incorporated by reference into this Agreement. You can review the Privacy Policy on our website.

b. Instructor Terms:

• If you are an instructor, you are subject to the Instructor Terms and Conditions, which are also incorporated by reference into this Agreement. In case of any conflict between these Terms and the Instructor Terms, the Instructor Terms will prevail.

3. Course Registration

a. Account Responsibility:

• To access certain products, you must register and obtain an account. You are responsible for maintaining the confidentiality of your account information and must notify us of any unauthorized use promptly.

b. Transfer of Account:

• You may not transfer your account to others or use someone else's account without permission. If you authorize another individual, you are responsible for their online conduct and the consequences of any misuse.

4. Course Withdrawal and Refunds

a. Student Refunds:

• VITyarthi provides a seven-day, no-questions-asked money back guarantee for courses not purchased through the mobile applications. Refund requests must be made within seven days of payment, with notification sent to info@vityarthi.com within the first hour of registration.

b. Instructor Payments:

• Instructors acknowledge students' refund rights. In case of a refund, VITyarthi may deduct the amount from the next payment to the instructor or require a refund if already paid.

c. Refund Exceptions:

• Full refunds may not be possible if a course is fully consumed or content is downloaded before the refund request. Abuse of the refund policy may result in account suspension.

5. Instructor Obligations Using the Site

a. Approval and Enrollment:

• Instructors are subject to Company approval and must complete the Instructor enrollment form at https://vityarthi.com. Premium Instructor Pricing terms apply if charging fees.

b. Content Ownership and Rights:

• Instructors must own or have necessary licenses for submitted content. They grant VITyarthi a license to reproduce, distribute, and use the content. Instructors must not post inappropriate or offensive content.

6. Student Obligations Using the Site

a. Disputes:

• VITyarthi is not involved in instructor-student disputes. Students must agree to pricing terms, be over 18, or use the platform with parental approval.

b. Content and Conduct:

• Students agree not to post unsolicited materials, inappropriate content, or disclose personal information to instructors.

7. Content, Licenses & Permissions

a. Content Ownership:

• All content, whether Company or User-generated, is protected by copyright laws. Users grant a license to VITyarthi to use submitted content on the platform.

8. Limitation of Liability

a. Liability Limitation:

• Both parties limit liability under applicable law. The company's total liability is limited to amounts paid for the courses or products giving rise to the liability.

b. Exceptions:

• This section does not exclude liability for fraud, death, personal injury resulting from negligence, or any other liability that cannot be limited or excluded by law.

By using VITyarthi, you agree to these terms. We reserve the right to update this Agreement, with changes effective upon posting on the VITyarthi website. Continued use implies acceptance of the modified terms.
